One Health Telemedicine Terms of Service

We encourage you to read this document to understand the terms, policies, and more that apply to you when you use our websites, products, or services, including how we process your personal information and how you can update and manage that information.

One Health Telemedicine, Inc. ("One Health", "Company", "we", "us", or "our") operates the website located at onehealthtelemedicine.com, products, services, and mobile applications with links to this Terms of Service ("Terms"), Please read these Terms carefully before using the Services. By visiting or using any of the Sites or Services, you are accepting the practices and provisions described in these Terms, as well as our Privacy Policy, and other terms, agreements, statements of rights, consent forms, and policies referenced above. If you do not agree to these Terms, or any of the documents referenced above, please do not use our Sites or Services.

Where visiting or using any of our Sites or Services, or any other website or mobile application that reference or link to these Terms, your information will be processed by One Health for the purposes stated in the One Health Privacy Policy, where applicable and legally permissible.

Update To These Terms and Conditions

One Health's Sites are owned and operated by One Health. Our Sites are continually under development and changes to the Sites or Services may be made at any time. We reserve the right to revise or remove any part of these Terms in our sole discretion at any time and without prior notice to you, except where legally required. Thus, you should visit this page periodically for changes. Any changes to these Terms are effective upon posting to the Sites, unless otherwise specified. If you disagree with these Terms, your sole remedy is to discontinue your use of the Sites and Services. Your continued use after a change has been posted constitutes your acceptance of the changes.

Health Services & Information

By using One Health's services you are consenting to engage in telemedicine with One Health Telemedicine, Inc, as part of your treatment. You understand that "telemedicine" includes the practice of health care delivery, diagnosis, consultation, treatment, transfer of medical data, and education using interactive audio, video, or data communications. You understand that telemedicine also involves the communication of your medical/mental information, both orally and visually, to health care. You understand that you have the following rights with respect to telemedicine:

  • (1) You have the right to withhold or withdraw consent at any time without affecting your right to future care or treatment nor risking the loss or withdrawal of any program benefits to which you would otherwise be entitled.
  • (2) The laws that protect the confidentiality of your medical information also apply to telemedicine. As such, you understand that the information disclosed by you during the course of your visit is generally confidential. However, there are both mandatory and permissive exceptions to confidentiality, including, but not limited to reporting child, elder, and dependent adult abuse; expressed threats of violence towards an ascertainable victim; and where you make your mental or emotional state an issue in a legal proceeding. You also understand that the dissemination of any personally identifiable images or information from the telemedicine interaction to researchers or other entities shall not occur without your written consent.
  • (3) You understand that there are risks and consequences from telemedicine, including, but not limited to, the possibility, despite reasonable efforts on the part of your provider, that: the transmission of your medical information could be disrupted or distorted by technical failures; the transmission of your medical information could be interrupted by unauthorized persons; and/or the electronic storage of your medical information could be accessed by unauthorized persons. In addition, you understand that telemedicine-based services and care may not be as complete as face-to-face services. You also understand that if your provider believes you would be better served by another form of services (e.g. face-to-face services) you will be referred to a provider who can provide such services in your area. Finally, you understand that there are potential risks and benefits associated with any form of treatment, and that despite your efforts and the efforts of your provider, your condition may not be improve, and in some cases may even get worse.
  • (4) You understand that you may benefit from telemedicine, but that results cannot be guaranteed or assured.

Laboratory Consent: By using One Health's services, you acknowledge that One Health Telemedicine, Inc. have partnered with the below Laboratories for the purpose of analytical testing to identify the 2019 Novel Coronavirus (COVID-19) or other respiratory illnesses. You authorize each of the below Laboratories to analyze your sample and to release the results of this analysis to One Health Telemedicine, Inc. You certify that you have voluntarily provided a fresh and unadulterated nasal/cheek swab or oral fluid specimen for analytical testing to identify the 2019 Novel Coronavirus (COVID-19) or other respiratory illnesses. Billing Consent: You authorize your insurance plan to be billed and benefits to be paid directly to One Health Telemedicine, Inc or one of the below Laboratories for services you received. You acknowledge that individual service providers may be an out-of- network provider with your insurer. You are also aware that in some circumstances your insurer will send the payment directly to you. You agree to endorse the insurance check and forward it to One Health Telemedicine, Inc. within 30 days of receipt. Failure to do so may result in your account being forwarded to collections and reported to a credit bureau. When ordering tests in which Medicare reimbursement will be sought, physicians (or other individuals authorized by the law to order tests) should only order tests that are medically necessary for the diagnosis or treatment of a patient rather than screening purposes. MAY BE BILLED SEPARATELY IN ACCORDANCE WITH CARRIER POLICIES. ALL

MEDICAL AND LABOATORY PROCEDURES WILL BE BILLED TO THIRD PARTY

CARRIERS (INCLUDING MEDICARE, MEDI-CAL) AT PRICES BILLED TO

PATIENTS. Term of Authorization: This authorization shall be valid for all PCR (Polymerase Chain Reaction) or RPP (Respiratory Pathogens Panel) tests that I have requested from One Health.

Services & Fee Schedule

Current Procedural Terminology codes (CPT codes) are a standardized set of numeric and alphanumeric codes developed by the American Medical Association (AMA) to describe medical, surgical, and diagnostic services and procedures performed by healthcare professionals. These codes serve as a uniform "language" in the healthcare system for billing, insurance reimbursement, data collection, and tracking healthcare services and procedures, ensuring accuracy and efficiency across the industry. Our CPT codes and their descriptions used for billing: 99001: (The provider prepares a specimen collected from a patient at a location other than the provider's office and sends it to an outside laboratory for analysis) 99202: (CPT code 99202 is an Evaluation and Management (E/M) code for an office or outpatient visit with a new patient who requires a medically appropriate history and/or examination, paired with straightforward medical decision-making.)

99212: (The 99212 CPT code describes an Office or Other Outpatient Visit for an Established Patient, requiring straightforward medical decision-making and a total provider encounter time of 10-19 minutes.)

Privacy & Communications

HIPAA REQUIREMENTS: All patients have certain rights to privacy regarding their protected health information. These rights are given to them under the Health Insurance Portability and Accountability Act of 1996 (HIPAA).

Treatment (including direct and indirect treatment by other healthcare providers involved in my treatment); Obtaining payment from third party payers (e.g. your insurance company); The day-to-day health care operations of your practice. All patients will be informed of and given the right to review and secure a copy of their Statement of Privacy Practices, which contains a more complete description of the uses and disclosures of my protected health information, and my rights under HIPAA. We reserve the right to change the terms of this notice from time to time and when contacted will disclose it to our patients. All patients have the right to request restrictions on how their protected health information is used and disclosed to carry the treatment, payment, and health care operations, but that they are not required to agree to these requested restrictions. All patients may revoke this consent, in writing, at any time. However, any use or disclosure that occurred prior to the date they revoke this consent is not affected. Your physician understands the importance of patient confidentiality and is committed to the protection of your personal health information. All personal identification information is protected and stored on a secure server. All information given via the physician consult form or in a conversation with any of our employees is held in complete confidence.

Our employees adhere to the strict standards for patient confidentiality set by the American Medical Association and the Health on the Net Foundation. We do not share any of your personal information with any of our affiliate or associate sites. We will not release any personally identifying information to anyone unless mandated by federal or state laws. Aggregate statistical summaries may be released to third parties, but these statistics will contain no personally identifiable information. Due to the Covid-19 Pandemic, we are experiencing a high level of calls and requests for tests. The fastest and easiest way to receive results is through text message and/or email.

Acceptable Use

In your use of our Sites or any Services, you agree not to:

 Send or otherwise transmit to or through our Sites any unlawful, infringing, harmful, harassing, defamatory, threatening, hateful or otherwise objectionable material of any kind, any material that can cause harm or delay to the Sites or computers of any kind, and any unsolicited advertising, solicitation or promotional materials;

 Misrepresent your identity or affiliation in any way;

 Restrict or inhibit any person from using the Sites, disclose personal information obtained from the Sites or collect information about users of the Sites;  Reverse engineer, disassemble or decompile any section or technology on the Sites, or attempt to do any of the foregoing;

 Gain unauthorized access to the Sites, to other users' accounts, names, personally identifiable information or other information, or to other computers or websites connected or linked to the Sites;

 Launch or use any automated system, including without limitation, "robots," "spiders," or "offline readers," that access the Sites in a manner that sends more request messages to our servers in a given period of time than a human can reasonably produce in the same period by using a conventional web browser;  Send or otherwise transmit to or through the Sites chain letters, unsolicited messages, so-called "spamming" or "phishing" messages, or messages

marketing or advertising goods and services;

 Post, transmit or otherwise make available any virus, worm, spyware or any other computer code, file or program that may or is intended to damage or hijack the operation of any hardware, software or telecommunications equipment;

 Violate any applicable laws, including wire-tap laws, or regulations or these Terms;

 Use abusive, harassing or threatening language or make abusive, harassing, bullying or threatening communications toward any staff member, any physician, or any other user of the Sites;

 Create a hostile environment for any staff member, any physician, or any other user of the Sites based on such person's race, age, national origin, disability, gender or reassignment thereof, religion or belief, sex, sexual orientation, marriage/partnership status, or pregnancy/maternity.

 Alter or modify any part of the materials or Services offered on the Sites; or  Assist or permit any persons in engaging in any of the activities described above. Any of the foregoing may result in actions including but not limited to termination of your access to the Sites or any of the Services.

Our Intellectual Property Rights

The content on the Sites, including without limitation, any text, software, graphics, photos, sounds, music, videos, audiovisual combinations, patents, interactive features, any trademarks, service marks and logos contained therein and any other materials you may view on, access through, or contribute to the Sites (collectively "Materials") are owned by or licensed to One Health Telemedicine, Inc., subject to copyright, trademark and other intellectual property rights under United States and foreign laws and international conventions.

No Materials from the Sites may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way without written permission of the rights owner. You agree not to circumvent, disable, or otherwise interfere with security related features of the Sites or features that prevent or restrict use or copying of any Materials or content. These Terms permit you to use the Sites for your personal, non-commercial use only. Modification of any Materials or use of any Materials for any other purpose is a violation of the copyrights and other proprietary rights of One Health Telemedicine, Inc., or of other entities or persons where so indicated, unless One Health Telemedicine, Inc. or the owner has provided said Material for such express purpose. Permission for all other uses of Materials contained herein, including reproducing and distributing multiple copies or using Materials on any other website or networked computer or linking to any secured or private page at the Sites must be obtained from One Health Telemedicine, Inc. or the appropriate rights owner in advance; otherwise, such use is prohibited. Requests for such authorization from One Health Telemedicine, Inc. should be submitted via an email to info@onehealthtelemedicine.com.

All design rights, databases and compilation and other intellectual property rights associated with the Sites, in each case whether registered or unregistered, and related goodwill, are proprietary to One Health Telemedicine, Inc..

Third Party Interactions

Your interactions with entities or individuals found on or through the Sites or the Services provided through the Sites, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such entities or individuals. You should make whatever investigation you feel necessary or appropriate before proceeding with any online or offline transaction with any third party. You are solely responsible for, and will exercise caution, discretion, common sense and judgment in, using the Sites and disclosing personal information.

You agree that One Health Telemedicine, Inc. shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings. If there is a dispute between you and any third party, you understand and agree that we are under no obligation to become involved.

Termination

One Health Telemedicine, Inc. may terminate your use of the Sites or any of our features or Services at any time and for any reason without notice for conduct violating these Terms. We will terminate a user's access to the Sites and its features or any Services if, under appropriate circumstances, the user is determined to be a repeat infringer of third-party rights or in breach of the applicable Terms. Upon any such termination, you must destroy all Materials obtained from the Sites and all copies thereof. The provisions of these Terms concerning Sites security, prohibited activities, copyrights, trademarks, disclaimer, limitation of liability, indemnity and jurisdictional issues shall survive any such termination. You agree that if your use of the Sites is terminated pursuant to these Terms, you will not attempt to use the Sites under any name, real or assumed, and further agree that if you violate this restriction after being terminated, you will indemnify and hold us harmless from any and all liability that we may incur therefore.

Disclaimer

The materials in the Sites are provided "as is" and without warranties of any kind, either express or implied. To the fullest extent permissible pursuant to applicable law, One Health Telemedicine, Inc. disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the functions contained in the materials will be uninterrupted or error-free, that defects will be corrected or that the Sites or the server that makes it available are free of viruses or other harmful components. We do not make any representations or warranties regarding the use or the results of the use of the materials in the Sites in terms of their correctness, accuracy, reliability or otherwise. Applicable law may not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

Limitation of Liability

To the extent permitted under applicable law, under no circumstances, including, but not limited to, negligence, shall One Health Telemedicine, Inc., be liable for any compensatory, punitive, special or consequential damages that result from the use of, or the inability to use, the Sites or the Materials on it, even if we, or an authorized representative of us has been advised of the possibility of such damages. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages, so the above exclusion may not apply to you.

Indemnity

You agree to indemnify, defend and hold One Health Telemedicine, Inc. and its directors, officers, employees, agents and contractors harmless from and against any and all claims, damages, losses, costs (including without limitation reasonable attorneys' fees) or other expenses that arise directly or indirectly out of or from (i) your breach of any provision of these Terms, or (ii) your activities in connection with the Sites.

Geographical Restrictions

One Health Telemedicine, Inc. makes no representation that all products, services and/or material described on the Sites, or the Services available through the Sites, are appropriate or available for use in locations outside the United States or all states and territories within the United States.

One Health Telemedicine Privacy Policy

This Privacy Policy ("Privacy Policy") explains how One Health Telemedicine, Inc., its affiliates, and its subsidiaries ("One Health," "us," "our," and "we") use your information and applies to all who use our websites and platforms – including mobile applications, touch technologies, electronic services, social networking sites, interactive features, online services or any of our described online activities we own or control (collectively, the "Service").   • otherwise with your consent.

We may disclose the following categories of personal information for our own business and operational purposes:

  • Identifiers;
  • Commercial information;
  • Inferences regarding preferences or characteristics.

We do not sell or rent personal information to third parties. Where a disclosure could be deemed a "sale" under applicable state law, you may exercise your right to opt-out by contacting us at info@onehealthtelemedicine.com.

We maintain administrative, technical, and physical controls designed to reasonably safeguard personal information. No method of transmission over the Internet, or method of electronic storage, is 100% secure; therefore, we cannot guarantee absolute security.
